Traders drag Anambra govt to court over levies, tolls

ONITSHA — Traders at Igbo-Ukwu community in Aguata Local Government Area of Anambra State, on the platform of Oganiru Plank and Joint Association, Igbo-Ukwu, have dragged the state government to court, seeking to stop the government from enforcing payment of Park Revenues, Park Development Levy and Park Sanitation tolls.

In a six-paragraph pre-action notice No. A/PR/98/14, filed at the Awka High Court Registry, the plaintiffs, Martin Eze, chairman and Joseph Nduaguba, Secretary, for themselves and other members of the association, are asking the court to stop the defendants from enforcing the payment of the above-mentioned revenues.

The plaintiffs contended that it was illegal and unconstitutional for the defendants, Government of Anambra State, Governor of Anambra State, Deputy Governor of Anambra State, Attorney-General of the state, Commissioner for transport, Anambra State Waste management Agency and Special Assistant to the Governor on Parks and Markets, through those who claimed to be working for them, to demand and collect these levies from members of the association, their customers and visitors.

They urged the court to make an order of injunction restraining the defendants by themselves or through their agents and privies from any further demand for the revenues from them.

In the pre-action notice dated October 30, 2014 and filed on their behalf by their legal counsel based in Onitsha, Ejike Dfobi, the proposed plaintiffs are seeking a declaration of the court that the government of Anambra State did not establish any park being used by or under the operation, management or control of the proposed plaintiffs to entitle the government or her functionaries demand for the revenues from them, their customers and visitors.

A declaration that the proposed defendants’ demand from them, their customers and visitors for payment of park revenue, park development levy and park sanitation toll is unconstitutional, illegal, null, void and of no effect, adding that the use of thugs by the proposed defendants on the proposed plaintiffs for the purposes of collecting revenues from them is quite illegal.
