Lagos Chief Judge says Nigeria Criminal Justice System can address cybercrime

The Chief Judge of Lagos State, Justice Olajumoke Atilade, on Tuesday said the Nigeria Criminal Justice System had the ability to deal with problems associated with cybercrime.

Atilade made this assertion in Lagos while delivering a keynote address at the 5th Annual Payment Systems and Fraud Conference 2014 entitled: “Legal Challenges and Solutions in Fighting Electronic Fraud”.

The News Agency of Nigeria (NAN) reports that the conference was organised by the E-Payment Providers Association of Nigeria (E-PPAN) in association with the Central Bank of Nigeria (CBN).

NAN reports that the conference has the theme “Unbundling the Criminal Justice Process in a Digital Economy”.

Represented by Justice Atinuke Ipaye of an Ikeja High Court, Atilade said that e-payment industry was prone to manipulations and attack from both internal and external aggressors.

She said that the challenges in dealing with the issues of cyber security had necessitated the development of appropriate tools and strategies for combating e-crimes and e-fraud in Nigeria.

Atilade defined fraud as a false representation of a matter of fact whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed.

She said that the intent of fraud was to deceive another so that the individual or company would act upon it to his or her legal injury.

“Fraud may take many forms, including but not limited to advance fee fraud, obtaining by false pretenses, bank card and cheque fraud, credit and or debit card fraud, identity fraud or theft.

“Loan scams, mobile phone fraud, money laundering, online fraud, phishing, lottery scams to mention a few.

“Shorthand way of identifying fraud is dishonesty calculated for pecuniary advantage.

“` You will agree with me that the world of crime is getting increasingly sophisticated even as society moves from the mainly agrarian economy to a digital economy,” Atilade said.
